Welcome to Eidson Aerial Photography, LLC. By accessing our website, booking our services, or receiving media content from us, you agree to the following Terms and Conditions. Please read them carefully.

1. Services Provided

Eidson Aerial Photography, LLC offers aerial drone photography and videography services for commercial, residential, industrial, and personal use. All services are subject to availability, weather conditions, airspace restrictions, and FAA regulations.

2. Client Responsibilities

Clients must ensure all necessary permissions and access are granted for the property or subject to be captured.
Clients are responsible for complying with any local ordinances related to drone operations on private or public property.
Clients agree not to request services that would require illegal or unsafe drone operations.

3. Media Usage and Licensing

Unless otherwise specified in a written agreement, all drone imagery and videos remain the property of Eidson Aerial Photography, LLC.
Clients are granted a non-exclusive, non-transferable license to use delivered media for the agreed purpose (e.g., real estate listing, marketing, personal use).
Redistribution, resale, or corporate use without prior written permission is prohibited.

4. Scheduling and Cancellations

Appointments are subject to rescheduling due to weather or FAA restrictions.
Cancellations made less than 24 hours before the scheduled flight may incur a cancellation fee unless waived at our discretion.
In cases where a flight cannot be completed due to no fault of the company (e.g., unsafe conditions, access denial), partial charges may apply.

5. Payment Terms

All services are invoiced upon completion or as stated in a project agreement.
Payments are due within the specified timeframe on the invoice (typically Net 15 unless otherwise agreed).

6. Limitations of Liability

Eidson Aerial Photography, LLC is not liable for damages arising from the use or inability to use delivered media.
We are not responsible for delays or service disruptions due to weather, mechanical failure, or airspace restrictions.
All drone operations are conducted in accordance with FAA Part 107 rules. If restricted airspace or local laws prohibit flying, the mission will be canceled or adjusted accordingly.

7. Intellectual Property

All content produced by Eidson Aerial Photography, LLC is protected under copyright laws.
Unauthorized use, duplication, or editing of our work without written consent is strictly prohibited.

8. Privacy

Our handling of personal data is governed by our Privacy Policy. By using our services, you consent to the collection and use of information as outlined therein.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Tennessee. Any disputes will be handled in the appropriate courts located in Shelby County, TN.

Return and Refund Policy

At Eidson Aerial Photography, LLC, customer satisfaction is important to us. Due to the custom and digital nature of our drone photography and videography services, all sales are considered final. However, we stand behind the quality of our work and will make reasonable efforts to resolve any issues in good faith.

1. No Returns on Digital Products or Services

All drone photos, videos, and edited media are non-returnable and non-refundable once delivered, due to their digital and customized nature. This includes but is not limited to:

Aerial photographs and videos
Edited or unedited media files
Project deliverables provided via cloud or physical storage

2. Service Satisfaction Guarantee

If you are unsatisfied with the final deliverables due to a technical issue or clear deviation from the agreed scope of work:

You must notify us in writing within 7 days of receiving the content.
We will evaluate the request and, if deemed valid, may offer one of the following at our discretion:
- Re-editing the original footage or images
- Partial refund
- Rescheduling a follow-up shoot (if feasible and applicable)

Refunds or reshoots will not be granted for:

Client dissatisfaction based on aesthetic preferences not communicated beforehand
Denied flight permissions, FAA restrictions, or unsafe flying conditions
Weather-related rescheduling or cancellations outside our control

3. Deposits and Prepayments

Some projects may require a non-refundable deposit to secure scheduling or begin editing. This will be clearly communicated in the project agreement or invoice.

4. Technical Issues

If there is a failure in media delivery due to a fault on our end (e.g., corrupted files, incomplete delivery), we will reissue the media at no additional cost or offer an alternative resolution.
